　　17岁的同龄人大都在教室里奋发读书，他却无奈地背起沉重的行头，跟随父亲到郑州的建筑工地当起了小工。原以为捉襟见肘的生活从此会有一丝延续下去的希望，这个懵懂少年没想到，自己最亲近的父亲，竟然偷偷地弃他而去，从此音讯全无。

　　为了弄清父亲出走的真相，他踏上了长达7年的寻父之路……

　　迷茫，父亲离家出走

　　今年24岁的林清(化名)，朴实憨厚、勤恳踏实，是河南省南阳市的一名汽车维修工。在他的记忆中，家里的生活和父母的情绪时刻被“贫困”二字左右着。

　　林清的父亲原来在当地供销社上班，由于单位改制，成了一名下岗工人。

　　林清的母亲是一位勤劳的家庭妇女，除照顾3个子女之外，她把精力都花在了家里仅有的两亩农田上――因为这是他们全家5口人唯一的经济来源。

　　林家5口人挤在单位分给父亲的一间不大的房子里，过着常人无法想象的困顿生活。

　　从小懂事的林清把这些看在眼里，记在心上，他从来没有向父母要过一分零花钱，更别说能穿上一件像样的新衣服了。

　　眼看家里的生活到了揭不开锅的地步，为了减轻父母的负担，年仅17岁的林清做出了一个大胆的决定：跟父亲一起外出打工。

　　林清想借此改善家里的经济环境，让母亲不再唉声叹气，让读高中、学习优异的姐姐不再为辍学而偷偷地抹眼泪；让2岁的妹妹不再为了一个糖果而哭闹。

　　2005年春天，林清和父亲一起来到了郑州的一家建筑工地打工。看着工人忙碌的身影，林清仿佛看到了生活的希望。

　　林清不怕吃苦，他是家中唯一的男孩，他认为自己必须承担起责任来。林清平时干着和其他成年工友一样的苦活、累活，肩膀磨出了血痕，手上磨出茧子，他都没放弃。

　　突然有一天，正在工地干活的林清，接到一个朋友的电话，说南阳有一个很不错的就业机会，希望他能过来。于是，他跟家人商量后，就孑然一身来到南阳。

　　天不如人意，他在南阳待了好几天，也没找到顺心的工作。经过深思熟虑，林清还是决定回郑州工地干活。

　　但是，林清回到当初干活的建筑工地时，却听到一个令他十分震惊的消息：父亲在他离开后，已经辞职不干了！

　　年少的他，顿时感觉茫然无助，于是就找到了包工头了解情况。万万没有想到，还有一个坏消息在等着他：父亲把他们前几个月干活的工钱全部领走了。

　　7月21日，陆续有三四名今年参加高考的考生打电话到南宁职业技术学院(以下简称“南职院”)招生就业处，“20日，我在一家叫‘好易学网’的网站上填报了你们学校，今天查询已被录取了，且对方的‘招生老师’也确认我被录取了，但自治区招生考试院网站上你们留的电话和‘好易学网’上的电话不同，想问一下录取信息是不是真的？”南宁职业技术学院招生就业处负责人一惊：“广西8月2日才开始高职高专批的志愿填报，怎么可能已被录取？这肯定是招生骗局！”昨日，记者在好易学网上查询到，据不完全统计，竟有60多所高校的网页疑似被仿冒，其中多家高校招生负责人在接受记者采访时明确表示：从未在好易学网站上发布院校的招生信息，好易学网站上的相关网页是假的！网站造假网上发布招生假信息

　　在南宁职业技术学院招生就业处，该处梁处长为记者详细介绍了仿冒网页和南职院官方网页的不同之处。梁处长分别从好易学网首页和广西招生考试院网站点击打开南宁职业技术学院的网页，可以很明显地看到两个网页有所不同，但两个页面的风格极为类似，好易学网上南职院主页上的LOGO和图片都是直接复制于该学院的官方网。该学院招生办老师感叹道：“如果是不熟悉南职院官方网的人点击这个假网页，很可能分辨不出真假。”

　　梁处长给记者指出了真网与假网的区别：首先假网主页的LOGO和图片虽然与真网上一致，可是图片质量明显降低，略为模糊；真网上是动态图片附加学院的文字介绍，而假网上是选取动态图片的其中一张，没有附任何文字介绍。第二，假网上一样有学院动态，但内容简单，篇章数少。第三，假网联系方式处，校名和通讯地址都是正确的，可是邮编和联系电话与真网的不一致。招生办工作人员证实，南职院招生办根本不存在这个电话号码。而且在电话号码下方，还特意注明了“联系我时请说明在好易学网上看到的，谢谢！”字样，之后还附带QQ交谈，页面上浮动一个手掌图片，点击即可报名。第四，假网上的“入学须知”是复制南职院2009年的招生简章，招生专业名称及招生人数均没有更改，只是把2009年改为2010年。而2009年广西高职高专普通批录取分A、B类两个批次，但今年广西对录取批次进行了调整，高职高专普通批已没有A、B类之分，仅凭这一点，就可看出好易学网上的信息造假，南职院的招生老师戏称不法分子“仿得不够专业”。最为可笑的是，假网还在公告中提醒考生，警惕招生骗局，切勿上当受骗，并列举了3种骗术，告知考生如何识别并通过正确途径获知录取情况。梁处长表示，这是彻头彻尾的招生骗局！

　　60多所高校网页被仿冒本以为好易学网上只有上述的广西9所高校的网页被仿冒，但记者在该网站以“广西职业院校”和“广西普通高校”为关键词进行搜索，竟搜出近80个广西院校及这些院校二级学院的网页信息，其中涉及的高校有60多所(包括上述的9所高校)。这些网页全部设置成可在网上报名，其中包括广西大学、广西医科大学、广西中医学院、广西师范学院等。每一所院校的网页均有考生网上报名人数的显示，其中报读南职院的有83人，报读广西理工职业技术学院的有10人，报读广西水利电力职业技术学院的有5人。由于涉及的院校较多，记者无法一一核实这些院校网页是否都被仿冒。但记者随机对比了部分院校网页与其官方网页，均发现有不同之处，且好易学网上所有的网页设置风格和设在首页的9所高校的网页风格类似，但信息很简单，很多院校网页上“最新动态”栏里显示的竟全是2009年的消息，且在每一个院校网页上都设有网上报名，网页上写有“联系我时请说明在好易学网上看到的，谢谢！”字样。记者过招“招生老师”忌谈详情好易学网到底是一个什么样的网？记者从好易学网站公布的简介上看到，该网站自称是全国最专业、功能最齐全的网络招生信息服务网站，要“建立全中国最大、最活跃的网上招生互动平台，致力于解决求学者找学校难和教育机构招生难的问题，打造招生界的‘沃尔玛招生超市’。”页面下方显示的是一家香港集团公司的名称。

　　既然广西多所高校招生负责人均表示好易学网上的网页是假的，那么，在网上操作这些招生信息的人是如何骗取考生信任的呢？昨日，记者随机拨打了仿冒网页上的3个电话，只有一个电话拨通了。记者以考生家长的身份询问相关情况，接电话的是自称南职院招生办老师的男子。刚开始，该男子似乎对记者有所警觉，问了记者的姓名和籍贯之后，该“老师”就开始让记者先在好易学网上报名，称报名之后就会有老师主动联系考生。可是问及详细情况时，他又叫记者留下电话，说待会叫负责招生的老师联系记者。记者问其为什么网站上要注明联系老师时要说明消息来自好易学网。他回答，学院跟好易学网有合作，招生消息都是在其网上发布，除了广西之外，还在外省有相关网站发布招生信息。其间，当记者问及关于考生被学院录取的整个程序如何等相关问题时，该“老师”一直转移话题，不愿正面回答，只说报名就知道了。很明显，该“老师”的说法和南职院招生处处长的说法完全不一致。

　　特别提醒填志愿须上官方网站在采访中，广西一些高校的招生负责人对记者表示，稍懂广西高考录取政策的人都会知道，录取工作必须在自治区招生考试院的监督下完成。考生填报志愿须在自治区招生考试院的官方网站上完成，按现在广西的高考录取进度，高职高专批填报志愿须等到8月2日后；因此，绝不可能出现考生私自在院校报名后马上就能录取的事件。特别提醒的是，考生应多了解录取政策，谨防类似的招生陷阱。(当代生活报记者采写)

　　这两份案号同为(1998)东刑初字第8号的判决书，出具时间同为1998年4月30日，同样盖着山东省东明县法院的公章。其区别在于前者有民事赔偿，后者没有。尽管后来，仝建华拿上既有实刑又有民事赔偿的判决书，但至今他仍没拿到一分钱赔偿。

　　【一起案件两份判决】

　　手持两份判决书，仝建华向《法治周末》记者讲述了事情的经过。

　　1995年3月，仝建华见义勇为，被同事李国夺用自制枪支打成重伤。随后，李国夺因涉嫌故意伤害罪被东明县检察院提起公诉。东明县法院开庭审理后，法官代艳春于1998年4月30日通知仝建华领取判决书，于是他拄着双拐独自前往。

　　仝建华回忆说，在代艳春法官的办公室里，她把两份判决书摆在他面前。代艳春告诉他，他要是要钱，就拿判处李国夺3年有期徒刑、缓刑5年的判决书；如果不要钱，就拿判处李国夺4年有期徒刑的判决书。

　　这两份案号同为(1998)东刑初字第8号的判决书，出具时间同为1998年4月30日，同样盖着山东省东明县法院的公章，唯一的区别在于第二页中的判决结果。

　　东明县法院在一份关于此事的书面说明中承认：两份判决书的确都由东明县法院出具，但判处李国夺4年有期徒刑的那份判决书实际并未送达，所以无效 herve leger black dress。

　　菏泽市牡丹区人大常委会委员、山东天清律师事务所律师鲍文佩告诉记者，在其几十年的律师执业生涯中，像这样同时出具两份判决的事，从来没有听说过。

　　面对这样一个"选择权"，仝建华当即向代艳春表示："只要我不死，我不会选择判3年缓5年(的判决书)。"

　　仝建华告诉记者，当时代艳春对他说，如果接受判3年缓5年的结果，仝建华可以得到3万元补偿。否则，他得不到补偿。

　　"谁让你见义勇为了？"仝建华多次提到代艳春的这句反问。

　　网友在仝建华的帖子里回帖说："代法官没叫仝建华赔偿被告人子弹钱已经很不错啦。"

　　"我本来只想拿后一份判决，代法官不愿意。"仝建华对《法治周末》记者说，"我哭着走出代法官的办公室。代法官追上来对我说：'两份判决你都拿走，再考虑考虑。'"

　　在东明县法院的书面声说明中，记者看到的是另外一种说法："其(仝建华)趁刑庭法官代艳春不备将对被告人量刑4年的尚未对双方宣判送达的判决书拿走了一份。后来，法官代艳春发现判决书少了一份，便对仝建华进行询问并制作了笔录，仝建华承认拿走了一份判决书，法官让其将未生效的判决书交回法院，仝建华称判决书已被其撕毁。"

　　对此，仝建华予以否认："我怎么能从法院偷走判决书呢？"

　　东明县法院政策研究室主任景胜磊向记者表示：代艳春法官已经长期请病假，现在联系不到。而两份文件现在都在案件卷宗中，案件的卷宗按照规定属于保密范畴不能随意公开。

　　景胜磊表示，可以代为向上级法院请示，若得到准许会再联系记者。

　　仝建华告诉记者，随后，他拿着两份判决书向东明县检察院反映情况，当时的副检察长张俊岭对他说，这简直是拿国家的法律当儿戏。

　　【再审案结事未了】

　　1998年5月4日，东明县法院将一审判决书送达公诉机关、被害人和被告人，这份判决书上写着：判处被告人李国夺3年有期徒刑、缓刑5年。

　　东明县检察院认为此案量刑偏轻，向东明县法院提出了司法建议。

　　东明县法院经审委会讨论决定再审此案，于1998年10月15日下达了(1998)东刑再初字第1号判决。这一次，李国夺被判处有期徒刑4年，并赔偿仝建华各种损失7万余元。

　　仝建华对此判决表示不服，向东明县检察院申请抗诉。东明县检察院提出抗诉，同时，仝建华也就民事部分提出了上诉 women's ugg sandals。

　　1999年6月18日，菏泽地区中级法院就此案裁定撤销原判，发回东明县法院重审。

　　东明县法院另行组成合议庭重审此案，并作出与再审相同的判决。

　　仝建华向东明县检察院申请再次抗诉，被检察院拒绝。检察院向仝建华表示，他们已经尽力了。而按照刑事诉讼法的规定，在检察院拒绝抗诉之后，仝建华已经用尽了刑事诉讼普通程序中的救济渠道。

　　最终，检察院没有提起抗诉，被告人也没有上诉。

　　仝建华说，判决结果已经作出十余年了，但赔偿一直没有到位，他至今没有收到一分钱。"当时我申请他们(东明县法院执行局)立案，他们不给立，让我提供被告人的财产，让我提供被告人的车、房。(执行局)说，'你提供不了，出车，国家得烧多少油啊'，我一直找他们(执行局)，他们就是不给立案。"

　　景胜磊对《法治周末》记者表示，事情发生十多年了，现在法院的工作人员确实对当时的这起案件不太了解，"他不上网，我们都不知道这个事，领导都换了好几届了。"

　　【审判更像"走过场"】

　　仝建华认为，现在出现的这些问题都来源于审判过程的不规范---1998年3月19日，东明县检察院就李国夺故意伤害案向东明县法院提起公诉，仝建华作为被害人提起了附带民事诉讼。此案由魏学岭、吴东菊、代艳春3位法官组成合议庭并由代艳春负责主审。

　　根据仝建华的回忆，当日开庭，只有审判员代艳春和书记员郑东两人到场。合议庭的另外两位法官魏学岭和吴东菊没有出庭。

　　记者就此向东明县法院求证，景胜磊说："我们是组成了合议庭的，独任审判不可能。"

　　在庭审笔录上签字时，仝建华发现自己的很多发言没有被记录。仝建华当即对此提出了质疑："代艳春这样回答我：你说那么多，我们可能记得了吗？并在审判结束后让我在一张空白记录纸上签字，理由是：你不是说你说的很多话没有记录吗，你签好了以后再给你补上。"

　　仝建华还提到了一个细节：在法庭辩论阶段，法官像睡着一样趴在桌子上。

　　仝建华的家人当时坐在旁听席上，认为这次审判更像是"走过场"。

　　对于上述情节，记者向东明县检察院求证，检察院一位李姓的工作人员拒绝接受采访，称不记得这个案子。

　　景胜磊透露，东明县法院和菏泽中院已经成立了两个调查组调查此事，其中也包括执行没有到位的问题。菏泽中院已派员到东明法院调查，目前调查仍在进行。

　　判决结果能不能自选

　　对于让当事人选择判决这种行为，中国政法大学刑事司法学院学术委员会主席洪道德教授认为："虽然法律无明确规定不允许这么做，但这种做法无疑是荒唐的，是不妥当且不严肃的。"

　　洪道德认为，该案至少在诉讼程序上存在四点不正当的行为。

　　本案中的调解应当在宣判前进行，即使是现在还正处于试验阶段的刑事和解，也只能在宣判前进行而不能拿着判决书去选择。

　　即便是试验中的刑事和解，也应该交由当事人进行，任何一个国家的立法都不允许法官与被害人之间进行这一行为，因为这显然违背了法官的中立性。

　　将判决交给当事人去选择，由当事人对判决享有选择权，等于是把国家的审判权矮化成了当事人的处分权，严重损害了司法权威和审判权的正当行使。

　　最后，不同的量刑必然要依据不同的量刑情节，不同的量刑情节意味着相异的事实认定。两个判决就意味着对同一个案件认定了两个不同的事实，这不仅违反了判决的唯一性，更破坏了判决的事实依据。

　　全国律师协会刑事业务委员会委员许兰亭律师认为："司法实践中，这种行为可谓罕见，即便是对刑事附带民事部分进行调解，也应当在判决之前、由当事人之间达成调解协议。判决是唯一的，出具两份判决肯定是不被允许的。"
